I think you misunderstand the question. Rights are a legal fiction agreed upon in a functioning society. If the culture is homogeneous enough some legal fictions can persist in time, through the "social contract." When the culture of a society is no longer homogeneous the social contract goes out of the window and everything reverts to biological imperatives. Men and women are not the same, they occupy different roles in society, so the legal fictions known as rights that apply to either ***** should by default be different, as it always was historically after all.
